I have a domain that i wish to use for free email service, but it has a registered trademark.

can i still use?

What do you mean? What is the domain, and who has it registered as a trademark?

I would suggest to find another name. Think abou the situation if it was the other way around and you owned the tradmark.

well no problem untill u use the domain for bussiness oriented regarding the trademarks registers buss.

Once you get your name issues sorted out, lemme just make a kinda OT reccomendation. I suggest HiveMail or Socketmail, or @mail (atmail). All very good scripts for what you plan to do.

You can still do business if you aren't considered to be infringing upon their market. Look at the whole Monster Cable situation, how many law suits are they actually pursuing and winning? There are seven guidelines trademark attorneys use to ascertain whether a trademark infringes, but the sum of it is that the issue is not black and white, and if you are not in any way related with the other business it should be fine.

Definitely talk to a lawyer about this if you're going into business though.
